Abstract
This editorial by Benoit Frydman critiques the Belgian law of November 23, 1998, establishing legal cohabitation, designed to respond to the demands of homosexual couples seeking legal recognition and the protection of their rights. Benoit Frydman, although in favor of the principle of equality and the abolition of discrimination based on sexual orientation, denounces the major legal confusion that this law introduces between the concept of the couple and that of kinship, risking the legalization of incestuous unions. He particularly highlights the hypocrisy of the mechanism, reduced to its sole patrimonial effects to conceal its sexual and emotional dimension, which makes it potentially applicable to non-conjugal or even prohibited family relationships.

Cet éditorial de Benoit Frydman critique la loi belge du 23 novembre 1998 instituant la cohabitation légale, conçue pour répondre aux revendications des couples homosexuels en quête de reconnaissance légale et de protection de leurs droits. Benoit Frydman, bien que favorable au principe d'égalité et à l'abolition des discriminations fondées sur l'orientation sexuelle, dénonce la confusion juridique majeure que cette loi introduit entre la notion de couple et celle de parenté, risquant de légaliser des unions incestueuses. Il souligne particulièrement l'hypocrisie du dispositif, réduit à ses seuls effets patrimoniaux pour dissimuler sa dimension sexuelle et affective, ce qui le rend potentiellement applicable à des relations non conjugales ou même familiales interdites.
