Abstract
This address pays tribute to the pragmatic method of Professor Pierre Van Ommeslaghe, tracing how Belgian legal pragmatism, developed notably by Henri de Page and by Van Ommeslaghe himself, rejected an abstract conception of law in favour of understanding it as a practical instrument for resolving concrete problems, with rules acquiring meaning and life through their judicial applications and their real effects. Benoit Frydman connects this Belgian pragmatic tradition to the pragmatic turn in twentieth-century philosophy, influenced in particular by American legal realism (C. S. Peirce, William James, John Dewey) and by the work of Chaim Perelman within the School of Brussels, showing that legal pragmatism shares with contemporary philosophy a rejection of abstract metaphysics in favour of an analysis of practices. The speaker concludes by advocating the continuation of this method, characteristic of the ULB, notably through legal clinics, which involve students in handling real cases before the courts.

Cette allocution honore la méthode pragmatique du Professeur Pierre Van Ommeslaghe, retracant comment le pragmatisme juridique belge, développé notamment par Henri de Page et Van Ommeslaghe lui-même, a rejeté une conception abstraite du droit pour le concevoir comme un instrument pratique de résolution de problèmes concrets, les règles prenant sens et vie par leurs applications jurisprudentielles et leurs effets réels. Benoit Frydman rattache cette tradition pragmatique belge au tournant pragmatique de la philosophie du XXe siècle, influencé notamment par le réalisme juridique américain (C.S. Peirce, William James, John Dewey) et par les travaux de Chaïm Perelman dans le cadre de l'École de Bruxelles, montrant que le pragmatisme juridique partage avec la philosophie contemporaine un rejet de la métaphysique abstraite au profit d'une analyse des pratiques. L'intervenant plaide enfin pour la continuation de cette méthode caractéristique de l'ULB à travers notamment les cliniques juridiques, qui mobilisent les étudiants dans le traitement de dossiers réels devant la justice.
