Abstract
Benoit Frydman traces the philosophical tradition, from Plato to modern times, which equates the lawyer with the sophist and denigrates rhetoric as a mere art of persuasion serving the opinion of the moment. Against this millennial critique, he mobilizes the rehabilitation led by the Brussels School of Chaïm Perelman and his predecessor Eugène Dupréel, who recognize the essential and irreplaceable role of judicial argumentation in the construction of democratic justice. In a democracy and under the rule of law, truth is not a philosophical revelation but the laborious product of adversarial debate nourished by compelling arguments. The lawyer thus becomes the natural defender of democratic institutions against contemporary authoritarian ideologies that reject fair judicial procedures.

Benoit Frydman retrace la tradition philosophique, de Platon aux temps modernes, qui assimile l'avocat au sophiste et dénigre la rhétorique comme simple art de persuasion au service de l'opinion du moment. Contre cette critique millénaire, il mobilise la réhabilitation menée par l'École de Bruxelles de Chaïm Perelman et de son prédécesseur Eugène Dupréel, qui reconnaissent le rôle essentiel et irremplaçable de l'argumentation judiciaire dans la construction de la justice démocratique. En démocratie et dans l'état de droit, la vérité n'est pas une révélation philosophique mais le produit laborieux du débat contradictoire nourri d'arguments probants. L'avocat devient ainsi le défenseur naturel des institutions démocratiques contre les idéologies autoritaires contemporaines qui rejettent les procédures judiciaires équitables.
