Abstract

In this interview for the Bulletin du Barreau (March 2025), Benoit Frydman examines the lawyer's role and the notion of defense from a philosophical perspective. He traces philosophy's historical hostility toward lawyers from Platonic critique of sophists through Leibniz's dream of formal legal logic and Beccaria's judicial syllogism. Frydman emphasizes the post-World War II rehabilitation of contradictory debate through procedural philosophy and Perelman's argumentation theory, which recognize argumentative discussion as the sole legitimate means in a democratic rule of law. He then warns against contemporary dangers of artificial intelligence applied to justice, which revives the old dream of algorithmic legal calculation, and against abdication of critical judgment to technical expertise. The lawyer must remain guardian of a conception of truth and justice founded on argumentation, contradiction, and democratic deliberation, facing threats from both populism and technocratic dogmatism.
