Abstract
Benoit Frydman argues that judgment, in our legal culture, reconciles two competing historical traditions: the Greek democratic tradition, which values rhetorical argumentation and deliberation, and the biblical tradition, which grounds the authority of law in the written text and its interpretation. The modern trial is thus organized along two perpendicular axes — the horizontal axis of the argued dispute and the vertical axis of legal interpretation — requiring the judge to simultaneously arbitrate procedural debates and interpret legal texts. The analysis of judgment reveals three intertwined levels of discussion: the arguments of the parties, the secret deliberation of the magistrates, and the reasoned judgment, making the act of judging more complex than the simplified Napoleonic ideal.

Benoit Frydman soutient que le jugement, dans notre culture juridique, réconcilie deux traditions historiques concurrentes : la tradition démocratique grecque, qui valorise l'argumentation rhétorique et la délibération, et la tradition biblique, qui fonde l'autorité du droit dans le texte écrit et son interprétation. Le procès moderne s'organise ainsi selon deux axes perpendiculaires — l'axe horizontal du litige argumenté et l'axe vertical de l'interprétation juridique — exigeant du juge qu'il arbitre simultanément les débats procéduraux et interprète les textes de loi. L'analyse du jugement révèle trois niveaux imbriqués de discussion : les arguments des parties, la délibération secrète des magistrats et le jugement motivé, rendant le jugement plus complexe que l'idéal simplifié napoléonien.
