Abstract

Following the political crisis triggered by the Dutroux affair, Benoit Frydman analyzes the paradoxical relationship between justice and public opinion in Belgium. The establishment of the High Council of Justice aims to strengthen democratic control over the judiciary through transparency and public information. However, simultaneously, case law reveals an intensification of judicial censorship and sanctions against journalists criticizing magistrates, which contradicts the constitutional principle that in a democracy, it is public opinion that controls the powers and not the reverse.

À la suite de la crise politique ouverte par l'affaire Dutroux, Benoit Frydman analyse le rapport paradoxal entre justice et opinion publique en Belgique. L'établissement du Conseil Supérieur de la Justice vise à renforcer le contrôle démocratique sur la magistrature par la transparence et l'information publique. Cependant, simultanément, la jurisprudence connaît une intensification des censures judiciaires et des sanctions contre les journalistes critiquant les magistrats, ce qui contredit le principe constitutionnel selon lequel en démocratie c'est l'opinion qui contrôle les pouvoirs et non l'inverse.
