Abstract

Benoit Frydman analyzes how State sovereignty, traditionally expressed through territorial law, is being challenged by the transformations of the global economy and globalization. Faced with the shortcomings of territorial regulation, alternative or complementary modes of regulation exist that the law must address. The article identifies three levers of global law: forum shopping, used strategically to circumvent impunity (the Pinochet case, the Belgian universal jurisdiction law, the American Alien Tort Statute); corporate social responsibility; and technical standards as vectors of global law. Benoit Frydman emphasizes that the law requires weaker actors to master the techniques of cunning and reversal to thwart superior force, by identifying 'checkpoints' that enable the regulation of the global system.

Benoit Frydman analyse comment la souveraineté de l'État, traditionnellement exprimée par le droit territorial, se trouve remise en cause par les transformations de l'économie mondiale et la mondialisation. Face à la défaillance de la réglementation territoriale, il existe des modes de régulation alternatifs ou complémentaires dont le droit doit se saisir. L'article identifie trois leviers du droit global : le forum shopping, utilisé stratégiquement pour contourner l'impunité (affaire Pinochet, loi belge de compétence universelle, Alien Tort Statute américain) ; la responsabilité sociale des entreprises ; et les normes techniques comme vecteurs du droit global. Frydman insiste sur le fait que le droit exige que les acteurs plus faibles maîtrisent les techniques de la ruse et du retournement pour contrecarrer la force supérieure, en identifiant des « points de contrôle » permettant de réguler le système global.
