Abstract

Jacques Englebert and Benoit Frydman criticize Belgian case law, notably the 2000 Leempoel judgment of the Court of Cassation, which authorizes judges to preventively prohibit or limit the distribution of the press to protect the rights and reputation of individuals. The authors demonstrate that this ad hoc and arbitrary balancing of interests violates the absolute constitutional prohibition of censorship and contradicts the strict and well-established requirements of the European Court of Human Rights. According to the latter, limitations on freedom of the press must be predefined by law, precisely delimited, and justified by overriding public interests. Resorting to a case-by-case assessment undermines legal certainty and transforms the judge into a subjective arbiter of public debates.

Jacques Englebert et Benoit Frydman critiquent la jurisprudence belge, notamment l'arrêt Leempoel de 2000 de la Cour de cassation, qui autorise les juges à interdire ou limiter préventivement la diffusion de la presse pour protéger les droits et la réputation des personnes. Les auteurs démontrent que cette mise en balance ponctuelle et aléatoire des intérêts viole l'interdiction constitutionnelle absolue de la censure et contredit les exigences strictes et bien établies de la Cour européenne des droits de l'homme. Selon cette dernière, les limitations à la liberté de la presse doivent être prédéfinies par la loi, précisément délimitées, et justifiées par des intérêts publics supérieurs. Le recours à une appréciation au cas par cas mine la sécurité juridique et transforme le juge en arbitre subjectif des débats publics.
