Abstract
Benoit Frydman examines the paradoxical relationship between modern and postmodern juridical thought. While modernity aspired to ground political and social organization solely through reason—via the social contract, systematic legal codification, and mechanical jurisprudence—postmodernity has thoroughly deconstructed these epistemological foundations. Yet contemporary practice paradoxically invokes fundamental rights and constitutional principles with increasing frequency, revealing a pragmatic stance toward law despite recognition of its theoretical fragility.
