Abstract
Benoit Frydman analyzes the spectacular evolution of the relationship between law and political action in Belgium, characterized by a shift from the principle of the separation of powers toward an increasing intervention of judicial review. Traditionally, the separation of powers exempted political institutions from any legal constraint; this 'lawless zone' entrenched the political sphere in impunity. The situation changed rapidly under the pressure of scandals and an increased distrust toward public officials. Benoit Frydman particularly examines the Belgian law of February 12, 1999, regulating political parties that convey racist or xenophobic ideologies through mechanisms such as the prohibition of public funding and the correctionalization of offenses.

Benoit Frydman analyse l'évolution spectaculaire des rapports entre le droit et l'action politique en Belgique, caractérisée par un basculement du principe de séparation des pouvoirs vers une intervention croissante du contrôle juridictionnel. Traditionnellement, la séparation des pouvoirs exonérait les institutions politiques de toute contrainte juridique ; cette « zone de non-droit » confortait le monde politique dans l'impunité. La situation change rapidement sous la pression des scandales et d'une méfiance accrue envers les gouvernants. Benoit Frydman examine particulièrement la loi belge du 12 février 1999 régulant les partis politiques véhiculant des idéologies racistes ou xénophobes par des mécanismes d'interdiction du financement public et de correctionnalisation des délits.
