Abstract
Benoit Frydman examines the relationship between artificial intelligence and legal argumentation by tracing the historical debate between formalist approaches (the Leibnizian dream of substituting calculation for discussion) and the conception of the Brussels School, which grounds law in argumentation and rhetoric. He analyzes how various AI systems—expert systems, neural networks, and generative AI—impact judicial reasoning, arguing that probabilistic arguments derived from AI analysis can enrich legal argumentation without replacing the adversarial process. Finally, the work addresses the pedagogical challenge of training law students in the potential and risks of AI.
