Abstract
Benoit Frydman analyzes François Ost's essay 'From Sinai to the Champ-de-Mars,' a transitional work marking the author's shift from legal theory to literature. The work combines analysis of major literary texts, notably Exodus and Greek tragedies, with philosophical and juridical commentary, following a deliberate method that brings narrative discourse and argumentative discourse into resonance. Ost develops his central thesis of an inextricable intertwining between law and contract: there exists in social reality no chemically pure form, but rather molecules combining in variable doses imposed and negotiated elements. The essay explores the tension between sacred revelation (Sinai) and democratic reason (Champ-de-Mars), and mobilizes the mythic figure of Hermes as an alternative to Dworkin's model of Judge Hercule, thereby interrogating the theologico-political foundation of law and social bonds.

Benoit Frydman analyse l'essai Du Sinaï au Champ-de-Mars de François Ost, ouvrage de transition qui marque le passage de l'auteur de la théorie du droit vers la littérature. Le travail combine l'analyse de grands textes littéraires, notamment l'Exode et les tragédies grecques, avec des commentaires philosophiques et juridiques, selon une méthode délibérée qui met en résonance le discours narratif et le discours argumentatif.
