Abstract

Benoit Frydman examines the compatibility between the introduction of new public management within the judiciary and the fundamental values of the judicial function. The article identifies four inviolable principles that must frame any managerial reform: the independence of the judiciary vis-a-vis the other branches of government, the independence of the judge in the exercise of the adjudicative function, the legality of procedure, and respect for the principles of fair trial. It further stresses that the act of judging engages an infinite responsibility and a complete freedom of judgement, which are difficult to reconcile with a managerial logic grounded in performance control. Frydman concludes that judicial management must necessarily be a form of self-management exercised by the judiciary itself, so as to preserve the foundations of the rule of law and to prevent this importation of administrative techniques from becoming a 'Trojan horse' within the very apparatus constitutionally entrusted with ensuring the application of the law.

Benoit Frydman examine la compatibilité entre l'introduction du nouveau management public dans l'ordre judiciaire et les valeurs fondamentales du judiciaire. L'article identifie quatre principes inviolables qui doivent encadrer toute réforme managériale : l'indépendance du pouvoir judiciaire vis-à-vis des autres pouvoirs, l'indépendance du juge dans l'exercice de sa fonction juridictionnelle, la légalité de la procédure et le respect des principes d'une procédure équitable, tout en soulignant que l'acte de juger met en jeu une responsabilité infinie et une liberté totale du jugement qui sont difficilement compatibles avec la logique managériale reposant sur le contrôle de rendement. Frydman conclut que le management judiciaire doit nécessairement être un auto-management exercé par le pouvoir judiciaire lui-même pour préserver les fondements de l'État de droit et éviter que cette importation de techniques administratives ne devienne un « cheval de Troie » dans l'appareil constitutionnellement chargé de veiller à l'application du droit.
