Abstract
Benoit Frydman analyzes the phenomenon of transnational judicial dialogue as a manifestation of declining state legal positivism and evolving judicial authority beyond national borders. He traces how judges from different jurisdictions interact through formal institutional mechanisms and informal networks, creating an international judicial community bound by shared professional ethos and common commitment to universal justice. Yet Benoit Frydman argues this dialogue masks deeper political struggles in which different jurisdictions and legal cultures compete to impose their own conceptions of law, revealing that apparent consensus around universal justice conceals a fundamental contest in which powerful states seek to dominate the formulation of transnational law.

Benoit Frydman analyse le phénomène du dialogue judiciaire transnational comme une manifestation du déclin du positivisme juridique étatique et de l'évolution de l'autorité judiciaire au-delà des frontières nationales. Il retrace la manière dont les juges de différentes juridictions interagissent par le biais de mécanismes institutionnels formels et de réseaux informels, créant ainsi une communauté judiciaire internationale liée par une éthique professionnelle partagée et un engagement commun envers la justice universelle. Cependant, Benoit Frydman soutient que ce dialogue masque des luttes politiques plus profondes au sein desquelles différentes juridictions et cultures juridiques rivalisent pour imposer leurs propres conceptions du droit, révélant que le consensus apparent autour de la justice universelle dissimule un conflit fondamental où les États puissants cherchent à dominer la formulation du droit transnational.
