Abstract
Benoit Frydman introduces the modern concept of civil society and its emerging political role in contemporary democracies, drawing on the Dutroux affair in Belgium in 1996 and the anti-globalisation movements to illustrate its spectacular emergence on the political stage. He retraces the rich historical evolution of this concept from the ancient Greek political community to the modern era, examining how contemporary civil society has redefined itself as a 'third sector' composed principally of non-governmental organisations and social movements pursuing objectives of general interest while maintaining its independence from both the State apparatus and market forces. The author sets out three central questions that the volume proposes to address: the definition of civil society and the determination of its composition, the legitimate role it may play in national, European and international political processes, and the constitutional status, rights and responsibilities appropriate to it.

Benoit Frydman introduit le concept moderne de société civile et son rôle politique émergeant dans les démocraties contemporaines, en s'appuyant sur l'affaire Dutroux en Belgique en 1996 et les mouvements anti-mondialisation pour illustrer son émergence spectaculaire sur la scène politique. Il retrace l'évolution historique riche de ce concept depuis la communauté politique grecque antique jusqu'à l'époque moderne, examinant comment la société civile contemporaine s'est redéfinie en tant que « tiers-secteur » composé principalement d'organisations non gouvernementales et de mouvements sociaux poursuivant des objectifs d'intérêt général et maintenant son indépendance tant de l'appareil d'État que des forces du marché. L'auteur énumère trois questions centrales que l'ouvrage se propose d'aborder : la définition de la société civile et la détermination de sa composition, le rôle légitime qu'elle peut jouer dans les processus politiques nationaux, européens et internationaux, et le statut constitutionnel, les droits et les responsabilités qui lui conviennent.
