Abstract
Benoit Frydman analyzes the unjustified historical marginalization of oral pleading in contemporary legal methodology, a depreciation inherited from modern scientism that confines it to pure empiricism. Against this trend, he establishes that judicial rhetoric and oral pleading constituted the core of legal reasoning and its pedagogical transmission, from Roman Antiquity to medieval scholasticism, giving rise to the logical structures and fundamental concepts of law. Benoit Frydman identifies the factors favoring a contemporary rediscovery of the virtues of live adversarial argumentation by justice theorists and practitioners, which is called upon to renew a legal discourse adapted to current requirements.

Benoit Frydman analyse la marginalisation historique injustifiée de la plaidoirie dans la méthodologie juridique contemporaine, une dépréciation héritée du scientisme moderne qui la cantonne à l'empirie pure. Contre cette tendance, il établit que la rhétorique judiciaire et la plaidoirie ont constitué le cœur du raisonnement juridique et de sa transmission pédagogique, de l'Antiquité romaine jusqu'à la scolastique médiévale, donnant naissance aux structures logiques et aux concepts fondamentaux du droit. Benoit Frydman identifie les facteurs favorisant une redécouverte contemporaine des vertus de l'argumentation contradictoire vivante par les théoriciens et praticiens de la justice, appelée à renouveler un discours juridique adapté aux exigences actuelles.
