Abstract
Benoit Frydman analyzes the fundamental inadequacy of territorial domestic law to govern cross-border communications on the Internet. Through examples of French case law (the Gubler case, the Gigastorage case) and measures by authoritarian authorities attempting to filter information, he illustrates the practical impossibility of enforcing national legal restrictions on this network. He establishes that the decentralized architecture of the Internet and its inherently transnational character create a fundamental incompatibility with the classical model of territorialized state sovereignty and law based on local jurisdiction. The author notes in the introduction that several competing regulatory logics clash: state intervention through legislation and international cooperation, libertarian demands for total freedom of communication, and calls for self-regulation by network actors.

Benoit Frydman analyse l'inadéquation fondamentale du droit interne territorial pour régir les communications transfrontalières sur Internet. À travers des exemples de jurisprudence française (affaire Gubler, affaire Gigastorage) et des mesures d'autorités autoritaires tentant de filtrer l'information, il illustre l'impossibilité pratique de faire respecter les restrictions légales nationales sur ce réseau. Il établit que l'architecture décentralisée d'Internet et son caractère intrinsèquement transnational créent une incompatibilité fondamentale avec le modèle classique de souveraineté étatique territorialisée et de droit fondé sur la compétence locale. L'auteur note en introduction que plusieurs logiques de régulation concurrentes s'affrontent : l'intervention des États par la législation et coopération internationale, les revendications libertaires pour une liberté totale de communication, et les appels à l'autorégulation par les acteurs du réseau.
